Privacy Policy for EtoL

This Privacy Policy explains how EtoL and its publisher, Divine Red Roses LLC (“Divine Red Roses”, “we”, “us”, “our”), collect, use, disclose, and protect information when you use the EtoL mobile application for Android or Apple iOS devices (the “App”). By clicking “I Agree” or installing, downloading, purchasing or using the App, you hereby acknowledge and agree that you have read and understand this Privacy Policy and agree to be bound by the terms contained herein.

EtoL is designed so that most user content is handled locally on the device. However, some features rely on Google Play services, Android or App Store, Apple and iOS operating system integrations, communications providers, and selected third-party service providers. By using the App, you acknowledge the practices described in this Privacy Policy.

1. Scope

This Privacy Policy applies to information processed through the App, including information processed locally on your device, information processed by Google Play or platform services when you use App features, and information we receive when you contact us.

2. Information We May Access or Process

2.1 Device Permissions and User Content

  • Photos and videos. If you grant media access, the App may read photo and video metadata and media needed to display, select, rotate, save, or share content through App features. Content remains on your device unless you explicitly save, export, message, email, or otherwise share it.
  • Camera and microphone. If you grant access, the App may capture photos and videos, including audio for video recordings. Captured media is handled locally and may be saved to your device’s media library if you choose.
  • Contacts. If you grant access, the App may read contact names, phone numbers, email addresses, and contact thumbnails to support phone, contact-picking, and related convenience features. The App may also store an app-specific phone list locally on your device.
  • Location. If you grant access, the App may access device location while you use Find Me to display a map and create shareable location links or messages. The App may download map tiles from third-party map providers (such as OpenStreetMap contributors via a mapping library) when the map is displayed. We do not operate an advertising network and do not use location for targeted advertising in the App.
  • Passwords and secure entries. If you use password-management features, the App may store password-related entries locally in an encrypted on-device vault excluded from device backup where supported.
  • Battery level. If you enable battery-monitoring features and grant notification permission, the App may read battery level locally to deliver low-battery alerts. Battery data is not sold or used for advertising.

2.2 Purchase and Transaction Information

  • If you make in-app purchases, Google processes the transaction through Google Play Billing.
  • The App may receive transaction status information such as product identifiers, entitlement state, purchase state, purchase timestamps, acknowledgement state, and restore status.
  • For support diagnostics, the App may record privacy-safe purchase technical diagnostic information (for example product identifiers, billing response codes, technical timestamps, an app support identifier, app version, locale/timezone, and device type).
  • If a paid entitlement is revoked or unavailable, the App may enforce limited trial use of certain gated features (for example, a capped number of password-manager actions or media-sharing actions, with limited grace uses) before purchase is required again.
  • We do not receive or store your full payment card details and only receive payment information provided by Google.

2.3 Diagnostics, Crash, and Performance Data

  • The App uses Sentry for crash reporting, diagnostics, and performance monitoring when configured.
  • This may include technical information such as device information, operating system details, app version, build number, crash traces, error logs, performance traces, an app support identifier, and limited diagnostic context.
  • We do not intentionally include payment card numbers, purchaser email addresses, or raw purchase tokens in Sentry technical diagnostic information payloads. Order identifiers may be redacted or truncated in technical diagnostic information.

2.4 Communications

  • If you use Feedback or otherwise contact us, we may receive your name, email address, message contents, attached files, and any other information you choose to provide.
  • If you use the App to send photos, location links, emails, or messages to third parties, the content you choose to send is processed by the destination platform or provider you select through Android or Apple.

2.5 Local Preferences and Operational Data

  • The App may store local preferences and operational state such as accessibility settings, app appearance, phone-list refresh state, legal-consent state, password data, purchase-related state, pinned contacts, map tile cache, and battery-monitor notification state.

3. How We Use Information

We may use information to:

  • Provide, operate, secure, maintain, and improve the App and its features.
  • Display, edit, save, rotate, manage, or share user-selected photos and videos.
  • Support phone, contact, password, battery-monitor, and location-sharing features.
  • Verify purchases, restore entitlements, enforce trial limits, and manage access to paid features.
  • Debug errors, monitor crashes and performance, prevent misuse, and protect the App and users.
  • Respond to support requests, feedback, legal requests, and operational inquiries.
  • Enforce our Terms of Service, establish or defend legal claims, and comply with applicable law.

4. Legal Bases Where Required

Where a legal basis is required by applicable law, we rely on one or more of the following: your consent, performance of a contract with you, legitimate interests in operating and protecting the App, and compliance with legal obligations.

5. When Information Leaves Your Device

While much of the App operates locally, information may leave your device in the following circumstances:

  • When Google Play or Apple process in-app purchases, entitlement checks, restores, or related billing functions.
  • When Sentry receives crash, error, performance, or billing-related technical diagnostic information from the App.
  • When map tile servers receive HTTP requests to load map imagery for Find Me.
  • When you send feedback or otherwise contact us by email.
  • When you intentionally share photos, videos, messages, location links, or emails through the App.
  • When required by law, court order, legal process, or to protect rights, safety, or property.

6. Disclosure of Information

We may disclose information to:

  • Google Play, Android, Apple and Apple-affiliated platform services involved in App distribution, purchase processing, or device features.
  • Sentry or similar service providers acting on our behalf for diagnostics and performance monitoring.
  • Map tile providers used by the Find Me feature when you view the map.
  • Email, message, share-sheet, communications, or other providers you select or invoke through the App.
  • Professional advisors, acquirers, successors, insurers, auditors, regulators, law enforcement, courts, and counterparties where reasonably necessary.

We do not sell personal information or knowingly use the App for cross-context behavioral advertising. We configure Sentry to exclude payment card numbers, purchaser email addresses, and purchase tokens from all technical diagnostic information. Order identifiers are automatically redacted before transmission.

We engage Google Play, Apple, Sentry, and map tile providers as service providers under written agreements that restrict their use of your information to providing services on our behalf and require them to implement appropriate security measures. These providers may process information as independent controllers for their own operational purposes as described in their respective privacy policies.

7. Storage and Retention

Local storage. The App stores certain information locally on your device, including app-specific contact lists, password entries, settings, legal-consent status, and operational state.

Device and platform storage. Photos, videos, Keychain items, secure credential storage, Google Play and App Store records, and other content may also be retained in platform-managed storage or device services based on your usage and settings.

Diagnostics and communications. Crash, performance, support, and communications records may be retained for as long as reasonably necessary for security, troubleshooting, analytics, support, audits, legal compliance, dispute resolution, or enforcement.

8. Security

We use administrative, technical, and organizational measures that we consider reasonable under the circumstances, including use of Android and iOS platform protections and secure storage features where applicable. However, no device, network, transmission, platform, or software service is completely secure, and we disclaim any guarantee of absolute security.

You are responsible for maintaining the security of your device, credentials, Google account, Apple account, backups, and any content you choose to store or share through the App.

In the event we become aware of a data breach that results in unauthorized access to, acquisition of, or disclosure of your personal information as defined under applicable law, we will investigate the incident promptly and, where required by applicable law, notify affected individuals and relevant regulatory authorities within the time frames specified by law. Notification will include a description of the incident, the types of information involved, steps we are taking to address the breach, and steps you may take to protect yourself. Notification may be provided by email to the address you provided, by prominent notice within the App, by postal mail, or by substitute notice (such as notice on our website) if we are unable to reach you by other means.

9. Children’s Privacy

The App is not directed to persons under 18, or under the age of digital consent in the applicable jurisdiction, and we do not knowingly solicit personal information from children under the age of 16 in violation of law. If you believe a child has provided us information contrary to law, contact us and we will review the request. If we learn we have collected personal information from a child under the age of 16 without verifiable parental consent, we will delete that information promptly.

10. Your Choices and Rights

  • You may control permissions through your device settings. Denying or revoking permissions may disable features.
  • You may delete locally stored App data by removing content in the App where supported or deleting the App.
  • You may request access, correction, deletion, restriction, portability, or objection rights where applicable law provides them.
  • You may stop optional communications by ceasing to use feedback or message-sending features.

Some information may remain in backups, platform-managed systems, diagnostics systems, communications systems, or legal/compliance records even after deletion from the App.

Depending on the laws applicable in your jurisdiction, you may have the following rights:

  • Access: Request a copy of the personal information we hold about you.
  • Correction: Request correction of inaccurate information.
  • Deletion: Request deletion of your personal information, subject to legal retention obligations.
  • Portability: Request your information in a structured, commonly used format.
  • Opt-Out: Opt out of sale or sharing of personal information (we do not currently sell or share).
  • Restriction/Objection: Object to or restrict certain processing.

To exercise these rights, email us at feedback@divineredroses.com with “Privacy Rights Request” in the subject line. We will verify your identity and respond within 45 days (or as otherwise required by law). We do not charge a fee for rights requests unless they are excessive or repetitive.

11. International Processing

The App is intended for users in the United States. If you access the App from outside the United States, you do so at your own risk and are responsible for compliance with local laws.

12. Changes to This Privacy Policy

We may update this Privacy Policy at any time. We will provide notice of material changes by: (a) posting the updated Privacy Policy within the App and on our website at divineredroses.com, with the “Last Updated” date revised; or (b) displaying an in-app notification or pop-up upon your next download of a new version of the App. Material changes will take effect ten (10) days after notice is provided, except where a shorter period is permitted or required by law. Your continued use of the App after the effective date constitutes acceptance of the modified Privacy Policy. If you do not agree to the modified Privacy Policy, you must stop using the App. We encourage you to review the Privacy Policy periodically. Changes that are not material (e.g., corrections of typographical errors, clarifications, or updates to contact information) will take effect immediately upon posting. Material changes may require renewed consent through the in-app legal gate.
